Terms and Conditions

Welcome to CAFolio (“CAFolio”, “we”, “us”, “our”). By accessing or using this website and any related forms or services, you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the website or submit information through our forms.

CAFolio participates in the Community Volunteer Income Tax Program (CVITP). These Terms are intended to be consistent with CVITP expectations for free, volunteer tax clinics.

1) Who we are

CAFolio is a volunteer‑powered, fully virtual tax clinic that supports eligible individuals with simple income tax and benefit returns. CAFolio operates under the CVITP but is not the Canada Revenue Agency (CRA) or Revenu Québec, and our volunteers are not acting as CRA employees or representatives, even if they may work for CRA in another role.

2) No fees and no gifts

CAFolio’s tax clinic services are provided free of charge, in line with CVITP program requirements. We do not accept payment, tips, gifts, or any form of compensation for preparing or filing returns through the clinic. If anyone asks you for money or gifts in connection with CAFolio, please let us know immediately.

3) Not legal, accounting, or financial advice

Information on this website and provided through CAFolio is for general information only. It is not legal, accounting, financial, or investment advice, and does not replace guidance from the CRA or a qualified professional.

Using this site or our services does not create an accountant–client, lawyer–client, or other professional advisory relationship. If your situation is complex or you need specific advice, you should contact the CRA directly or seek help from a licensed professional (for example, a CPA or tax lawyer).

4) Eligibility and scope of support

CAFolio supports eligible taxpayers with simple tax situations and modest incomes, consistent with CVITP guidance. Our clinic is fully virtual and operates only within the scope allowed under the CVITP.

We may be unable to assist if your return includes, for example:

  • Self‑employment or business income
  • Rental income
  • Significant capital gains or complex investments
  • Certain foreign reporting requirements (for example, T1135 – foreign income verification)
  • Bankruptcy returns
  • Returns for someone who has died (deceased returns)

Eligibility and capacity are assessed case by case. Submitting an intake form or contacting us does not guarantee that we can prepare your return or that we can do so within a specific timeframe (for example, before the filing deadline).

5) Your responsibilities

To use CAFolio services, you agree that you are responsible for:

  • Providing information that is complete, accurate, and up to date to the best of your knowledge.
  • Letting us know if any slips or documents are missing or if you receive them after you apply.
  • Reviewing your draft return when provided and confirming any corrections before we file.
  • Keeping your own records, slips, and receipts for as long as required by the CRA (often at least six years).
  • Responding promptly and directly to any CRA communications, including reviews, reassessments, or requests for documents.

You understand that:

  • The CRA may review or reassess any return, even when it was prepared carefully and in good faith.
  • You are ultimately responsible for your tax return and the information submitted under your name.

6) Consent and authorization to file

CAFolio will only prepare and file your return with your consent.

You may be asked to sign, acknowledge, or verbally confirm authorization documents that are used in CVITP workflows (for example, CRA taxpayer authorization forms, consent to use Auto‑fill or Represent a Client tools, or our own clinic consent form).

You may choose to allow us to retrieve available tax information from CRA systems (such as slips) using CRA tools.

You may also choose to decline these tools; however, this may limit what we can file or may require more information from you and could affect how quickly we can prepare your return.

You can withdraw your consent at any time before we file your return. If you withdraw consent, we will stop working on your return and handle your information according to our Privacy Policy and any applicable CVITP requirements.

7) Communication (virtual clinic)

CAFolio is a fully virtual clinic. We communicate primarily through online forms, email, phone, and other virtual methods.

  • To protect your privacy and reduce the risk of fraud and identity theft:
  • Do not send your Social Insurance Number (SIN), photo ID, or other highly sensitive information by regular, unsecured email unless we have specifically directed you to a secure method.
  • We may use safer options such as secure upload links, encrypted tools, or verification over the phone or on camera.

You are responsible for:

  • Ensuring your contact information (email, phone, mailing address) is correct.
  • Checking your inbox (including junk/spam folders) and voicemail for messages from us.
  • Letting us know if your contact details change.

Because CAFolio is virtual, there are no in‑person appointments or document drop‑offs.

8) Privacy

Your use of this website and our clinic services is also governed by our Privacy Policy (and any Consent/Authorization forms), which explains:

  • What information we collect
  • How we use, share, protect, and retain your information
  • When and how information is deleted or anonymized

If there is any conflict between these Terms and our Privacy Policy, we will interpret them in a way that best protects your privacy and complies with CVITP and applicable Canadian privacy laws.

9) Website and service availability

We aim to keep the website, forms, and virtual clinic operations available and functioning well. However, we do not guarantee:

  • Continuous or error‑free access to the website or forms
  • That we will have capacity to assist every person who contacts us
  • That we can meet specific timelines (for example, filing before a particular deadline)

We may update, pause, or discontinue parts of the website or clinic workflow at any time, including during peak tax season, for reasons such as capacity, technology changes, or program updates.

10) Limitation of liability

CAFolio volunteers strive to prepare accurate returns using the information you provide and CRA‑approved tools. However:

  • You remain responsible for the completeness and accuracy of your information.
  • The CRA (and, where applicable, Revenu Québec) is responsible for assessing your return, processing timelines, benefits and credits, refunds, balances owing, reviews, and reassessments.

To the fullest extent permitted by law, CAFolio and its volunteers, coordinators, and host organization are not liable for any damages, losses, or claims arising from or related to:

  • Errors, omissions, or inaccuracies in the information you provided.
  • CRA or other tax authority processing delays, reviews, reassessments, or decisions.
  • Your inability to access the website, forms, virtual tools, or appointments.
  • Issues related to third‑party services we use in good faith to support secure operations (for example, hosting, video platforms, secure forms), except to the extent required by law.

Nothing in these Terms is intended to limit your rights under applicable consumer or privacy laws where those laws do not allow such limitations.

11) Third‑party links and tools

Our site and virtual clinic workflows may:

  • Link to third‑party websites, such as CRA pages and community resources.
  • Use third‑party tools or platforms to support secure virtual operations (for example, secure forms, video platforms, document upload tools).

We do not control third‑party content, policies, or service availability and are not responsible for them. When you use third‑party services, their own terms and privacy policies may apply.

12) Intellectual property

Unless otherwise stated, the content on this website (including text, graphics, branding, and templates) is owned by CAFolio or used with permission.

You may use the website for personal, non‑commercial purposes only. You may not copy, reproduce, modify, or redistribute CAFolio content for commercial use without our written permission, except where sharing information for personal or community awareness is clearly allowed.

13) Acceptable use

You agree not to:

  • Misuse the website, forms, or systems.
  • Submit false, misleading, or fraudulent information.
  • Attempt to interfere with or gain unauthorized access to our systems or data.
  • Upload or transmit malicious code, files, or content.

We may restrict access to the website or decline services if misuse, fraud, or abuse of the clinic is suspected.

14) Children, youth, and dependants

CAFolio’s services are intended for individuals who can legally consent to the filing and authorization processes in their jurisdiction. When a return involves a youth or dependant:

  • A parent, guardian, or other eligible person may need to provide consent or authorization, as applicable.
  • We rely on the adult taxpayer’s confirmation that they are authorized to provide information about and on behalf of their dependants.

15) Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the CVITP program, CRA guidance, technology, or applicable laws. When we do:

We will post the updated Terms on this page with a new effective date.

Your continued use of the website or forms after changes are posted means you accept the updated Terms.

If a change is significant, we may highlight it on the site or within clinic communications.

16) Governing law

These Terms are governed by the laws of Canada and the applicable laws of the Province of British Columbia, without regard to conflict‑of‑law rules. Any disputes relating to these Terms or your use of this site will be dealt with in the courts of that province, unless applicable law requires otherwise.
